Until October 30, members of the management boards of all companies are required to declare in the commercial register the data of the actual beneficiaries of their companies.
You will need to provide:
- Name of the person, their personal identification code and country of personal identification code, if there is no personal identification code, date and place of birth, as well as the country of residence.
- Data on how the person exercises control.
For not providing data or providing incorrect data:
- A fine of up to 300 penalty units for an individual (currently up to 1,200 euros) or up to 32,000 euros for a legal entity. (The sanctions will come into force on 01.01.2019, so no one will be immediately punished)
- For violation of the obligation to establish the actual beneficiary, the law provides for a fine of up to 300 penalty units or arrest for an individual, and a fine of up to 400,000 euros for a legal entity. (RahaPTS chapter 40)
